Service Technicians & Installers
Service technicians, including those in the fields of air conditioning installation and repair, pest and insect control, as well as electricians, plumbers, and their assistants are often told by employers that because they get paid by the job or by the piece, they are not entitled to overtime compensation.
Similarly, many employees who perform custom installations of flooring, granite countertops, cabinets, and other residential and commercial materials regularly work over Forty (40) hours per week but are not paid properly for all of their hours worked, often because they are told that they are “independent contractors.” Further, some employers in these fields instruct their workers to record no more than Forty (40) hours on their time sheets while working out in the field, but in reality, most of these types of jobs fall within the overtime protections of the Fair Labor Standards Act.
